By using gameconsole grading services, you agree to the following terms and conditions:

1. Liability for Lost or Damaged Items

In the event that items submitted for grading are lost or damaged while in the custody of gameconsole Corp, the following provisions shall apply:

1.1 Compensation for Lost or Damaged Items

gameconsole will exercise reasonable and ordinary care in handling items submitted for the card grading Services. However, if gameconsole determines, in its sole discretion, that your item submitted for PSA Grading Services was lost, stolen, or damaged while in the possession or control of gameconsole (a “Loss Event”), gameconsole will compensate you as provided in this Section based upon the lesser of (i) the Declared Value and (ii) the fair market value of the item at the time of loss as determined by gameconsole standard procedures, which may include filing a claim with our insurance carrier. The Declared Value you provide with the submission form for your item is only an estimate of the insured value, and the fair market value of the item may be less than your Declared Value. IN NO EVENT SHALL gameconsole TOTAL LIABILITY, WHETHER CAUSED BY THE ACTIVE OR PASSIVE NEGLIGENCE OF gameconsole OR OTHERWISE, EXCEED THE LESSER OF THE FAIR MARKET VALUE OR THE DECLARED VALUE OF THE ITEM. gameconsole RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO DETERMINE THE FAIR MARKET VALUE FOR AN ITEM THROUGH ANY MEANS AS IT MAY DETERMINE. gameconsole may elect, depending on the condition of a damaged item, to either (a) return the item to you and compensate you for the reduction in value due to damage, or (b) retain the item and pay the maximum liability available under this section.

gameconsole has and will have no liability whatsoever to you for any loss or damage of any item occurring while the item is not in the custody or control of gameconsole, including, without limitation, after the item is transferred to the custody or control of a third party, including another facility, owner, agent, dealer, group submitter, or carrier, as identified by you, or released for return to you. gameconsole will not be liable or responsible for any consequential, incidental, special, or indirect damages, including, without limitation, for any intrinsic or sentimental value of an item.

1.2 Refund of Grading Service Costs

In addition to the compensation for the item described in Section 1.1, if a Loss Event occurs, gameconsole will refund the full cost of the grading service paid by you in relation to the lost or damaged items.

1.3 Fraudulent or Damaged Cards

gameconsole will not take or guarantee items which bear evidence of trimming, recoloring, restoration, or any other form of alteration or tampering, or that are of questionable authenticity, and you agree not to knowingly submit any such items. gameconsole bears no responsibility in respect of a Loss Event (defined in Section 1.1) for any such items. gameconsole may refuse to take items that are in its opinion critically damaged and/or too fragile, or may alternatively require that you release gameconsole completely from all liability whatsoever with regard to such items prior to performing the services.

1.4 Limitations of Liability

gameconsole has and will have no liability whatsoever to you for any loss or damage of any item occurring while the item is not in the custody or control of gameconsole, including, without limitation, after the item is transferred to the custody or control of PSA. gameconsole will not be liable or responsible for any consequential, incidental, special, or indirect damages, including, without limitation, for any intrinsic or sentimental value of an item.

2. Abandoned Goods

2.1 Abandoned Goods Event

Items shall be deemed Abandoned Goods if:

(a) Delivery is not accepted by you (or the your nominated party) at the agreed time and place, or

(b) You fail to take possession of any item within thirty (30) days from the date gameconsole notifies you that the item is ready for collection (“Notice Period”). Such notification will be sent via email to the email address you provided at the time of the transaction.

2.2 Storage of Abandoned Goods

If items are deemed abandoned, gameconsole may, at its sole discretion, store the Abandoned Goods at your sole risk and expense. gameconsole shall not be liable for any damages (direct or indirect) that may result from such storage.

2.3 Recovery of owed Service fees

You hereby agree that gameconsole may sell or destroy all or any part of the Abandoned Goods in an attempt to recover any unpaid fees related to the Services provided by gameconsole . You further agree that gameconsole may take such actions without further notice once the Goods are deemed abandoned.

We may revise any of the forgoing terms and policies at any time.
